MidiPhonics Terms & Conditions

  1. Fees is payable as follows, total four payments for the programme.
    1. 1st payment – Upon confirmation of lesson schedule (for week 1 – 5)
    2. 2nd payment – Week 4 (for week 6 – 10)
    3. 3rd payment – Week 9 (for week 11 – 15)
    4. 4th payment – Week 14 (for week 16 – 20)
  1. Fees must be paid 1 week prior to the start of lesson. Failing which the child will be denied excess to the e classroom.  To avoid disruption, parents are encouraged to pay fees promptly as per invoice.
  1. The withdrawal Notice Period is ONE calendar month.  Kindly email to info@thegardnerpreschool.com.sg to request for a withdrawal form.
  1. Fees paid cannot be transferred to another student.
  1. No replacement lesson or refund of fees if a student is absent for the session on his own accord.
  1. There will be no lessons during Gazetted Public Holidays. All dates are clearly marked out prior to start of programme, kindly take time to ensure that the student is available during these dates.
  1. The Company reserves the right to provide a replacement Trainer for the online lessons.  
  1. Should for any reason the scheduled lesson is cancelled, the Company reserves the right to offer a replacement lesson and students will be informed in advance.
  1. In the event of any technical glitches or for any reason beyond reasonable control such that the Company cannot provide the online courses; the Company & Parties’ maximum liability is the refund of fees collected for the remaining lessons on a pro-rated basis.  The Company & Parties will not be responsible for consequential damages. 
  1. Liability

In no event shall the company be liable for any claims, penalties, loss, damage or expenses, howsoever arising, out of or in connection with the use of the MidiPhonics Apps/ Programme, including, without limitation, direct or indirect loss, consequential loss or damage, loss of profit or goodwill, loss of data, loss arising from use or inability to use the MidiPhonics Apps/ Programme. 

  1. Intellectual Property Rights

Unless otherwise stated, the copyright and other intellectual property rights in all material on the MidiPhonics Apps/ Programme (including without limitation photographs and graphical images) are owned by our licensor.  All other rights which are not specifically granted are reserved.

  1. Use of material

You may view or download any part of the MidiPhonics Apps/ Programme for private purposes. Users are not permitted to use, reproduce, distribute, adapt, amend or exploit these materials for any other purpose or in any other medium or form, including for any revenue-generating purposes.

  1. Privacy

If we gather any information about you then such information will be gathered and used by us in accordance with our Privacy policy.

  1. Indemnity

You will indemnify and defend us against all claims, liability, damages, costs and expenses, including legal fees, arising out of a breach of these Terms and Conditions or any use of the MidiPhonics Apps/ Programme.

  1. Your Consent

By using the MidiPhonics Apps/Programme, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. “Processing,” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information. 

  1. By participating in this programme, you hereby give your consent for the Company to use video/photos of your child during his/her classes organized by the Company for marketing materials even after your child leaves the Programme. 
  1. You have read and accepted the Term & Conditions stated and understand that the Term & Conditions are subject to changes and the most current updates will be communicated to all students and parents.  

For register via our online portal / website, by clicking on the “Accept” button you agree to the terms of this agreement which will bind you. 

  1. Personal Data Protection Act (PDPA) & Privacy Policy
  1. Compliance of PDPA Policy

The Company is committed to complying with the Personal Data Protection Act passed by the Singapore Government in October 2012. 

  1. Personal Data

Personal data collected by the Centre includes students and their parent’s/guardian’s Full name, NRIC Number or FIN (Foreign Identification Number), Passport number, Photograph or video image of an individual, Mobile telephone number, Personal email address, Thumbprint, DNA profile and any other information relating to the person that has been provided to the school in one form or another.

  1. Purposes for the Collection, Use and Disclosure of Personal Data 

The collection of personal data will be use and/or disclose as follows: 

• Registration purposes 

• Administration purposes 

• Publicity and communication purposes 

• Verification and update purposes 

• Conducting research for statistical profiling and other purposes to review, develop and improve the services of the Centre 

• Conducting financial reporting and analysis related to the online courses operations 

• Archival of documents and records 

  1. Disclosure of Personal Data 

All Personal Data will be kept confidential and will not be disclosed to third parties without first obtaining your consent permitting to do so. However, please note that the Centre may disclose your personal data to third parties without first obtaining your consent in certain situations where such disclosure without your consent is permitted by the PDPA or by law. For more information on the exceptions, you are encouraged to peruse the Second, Third and Fourth Schedules of the PDPA which is publicly available at https://sso.agc.gov.sg/Act/PDPA2012 & www.pdpc.gov.sg.

  1. Management of Personal Data 

Appropriate security arrangements will be taken to prevent any unauthorized access, collection, use, disclosure, copying, modification, leakage, loss, damage and/or alteration of your personal data. However, the Centre cannot assume responsibility for any unauthorized use of your personal data by third parties which are wholly attributable to factors beyond the Centre’s control. 

The Company will retain personal data in accordance with legal, regulatory, business and operational obligations. When the Company cease retention, the personal data will be disposed of in an appropriate manner.
